1. DMCA Overview

MobileJSR respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (DMCA) of 1998. This policy describes our procedures for handling copyright infringement claims.

3. Filing a Copyright Infringement Notice

3.1 Notice Requirements

If you believe your copyrighted work has been infringed through a MobileJSR protected link, you may file a DMCA notice. Your notice must include all of the following information:

Required Information for DMCA Notice:

  1. Your identification: Name, address, phone number, and email address. Provide the signature (can be typed as “/signed” or electronic signature).
  2. Copyrighted work identification: Describe the copyrighted work(s) you claim have been infringed. If you claim infringement of multiple works, provide a representative list.
  3. Infringing material location: Provide the specific URL(s) or link(s) where you believe the infringing content is located. Be as specific as possible.
  4. Contact information: Full name, address, telephone number, and email address. If you are acting as an agent, include information about whom you represent.
  5. Good faith statement: Include the following statement: “I have a good faith belief that use of the copyrighted material described above and contained on the infringing web pages is not authorized by the copyright owner, its agent, or the law.”
  6. Accuracy statement: Include the following statement under penalty of perjury: “I swear, under penalty of perjury, that the information in this notice is accurate and that I am the copyright owner, or am authorized to act on behalf of the copyright owner, of an exclusive right that is allegedly infringed.”
  7. Copyright registration: If available, provide your copyright registration number(s) for the work(s) claimed to be infringed.
  8. Signature: Your physical or electronic signature. Type “/s/” followed by your name if submitting electronically.

3.2 Submission Instructions

4. Counter-Notice Procedure

4.1 Your Rights

If we remove your protected link in response to a DMCA notice and you believe this was done in error, you may file a counter-notice. Counter-notices must include:

  1. Your full name, address, phone number, and email address
  2. The specific protected link(s) that were removed
  3. A statement that you consent to jurisdiction of the Federal District Court
  4. Your signature (physical or electronic: “/s/” + name)
  5. The following statement under penalty of perjury: “I swear under penalty of perjury that I have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.”

4.2 Counter-Notice Submission

Send counter-notices to the same email address as DMCA notices:

4.3 Counter-Notice Timeline

After receiving a valid counter-notice, we will:

  • Notify the original claimant of the counter-notice
  • Wait 10-14 business days for the claimant to respond
  • If no response, restore the protected link
  • If claimant responds with legal action, wait for judicial determination

5. Our Response Process

5.1 Upon Receipt of Valid Notice

When we receive a valid DMCA notice, we will:

  1. Verify the notice contains all required information
  2. Verify the link is a MobileJSR protected link
  3. Notify the link creator of the infringement claim
  4. Disable access to the protected link
  5. Preserve evidence for legal proceedings
  6. Provide you with a copy of the notice

5.2 Timeline

  • Initial Response: Within 24-48 hours of receipt
  • Link Removal: Within 24 hours of verification
  • Claimant Notification: Within 2 business days

5.3 Invalid Notices

If a notice is incomplete or fails to meet DMCA requirements, we will:

  • Notify the submitter of the deficiency
  • Request corrected information
  • Not remove content until a valid notice is provided

7. Penalties for False Claims

7.1 Legal Consequences

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be subject to liability for:

  • Damages suffered by the affected party
  • Court costs and attorney’s fees
  • Criminal penalties in cases of fraud

7.2 MobileJSR Actions

We will take the following actions against false or fraudulent notices:

  • Document all false claims
  • Restore wrongfully removed content
  • Notify affected users
  • Report patterns of abuse to authorities
  • Pursue legal remedies when appropriate
